ASSIGNMENT

Summer 2015

Semester 4

BJ0016 – Media Laws and Media Ethics – 4 Credits

(Book ID: B0525)
(60 marks)

Answer the following questions:

Q. 1. Elaborate on the advantages of the Parliamentary form of Government. [10 marks]

Answer:Evidently, an executive in any system (be it parliamentary, presidential or semi-presidential) is chiefly voted into office on the basis of his or her party’s platform/manifesto. It could be said then that the will of the people is more easily instituted within a parliamentary system.

In addition to quicken legislative action, Parliamentarianism has attractive features for nations that are ethnically, racially, or ideologically divided. In a uni-personal presidential system, all executive power is concentrated in the president.

In a parliamentary system, with a collegial executive, power is more divided. It can also be argued that power is more evenly spread out in the power

Q. 2. How would you interpret the ‘Right to Freedom’ in a Democracy? [10 marks]

Answer:The freedom of expression is a right without which other rights are difficult to acquire and defend. The right to freedom of expression is rooted in the 17th century struggle of European legislators for freedom of speech. The world has seen a continuing struggle for the freedom of expression, including the freedom of speech and freedom of the press, often going hand in hand with the endeavour to limit the power of governments. The freedom of expression can be considered an essential aspect of the individual’s defence against government, just as the suppression of the freedom of expression is essential to tyranny

Q. 3. What is the meaning of ‘Writ of Quo Warranto’? Elaborate. [10 marks]

Answer:Quo warranto (Medieval Latin for "by what warrant?") is a prerogative writ requiring the person to whom it is directed to show what authority they have for exercising some right or power (or "franchise") they claim to hold.In the United States today, quo warranto usually arises in a civil case as a plaintiff's claim (and thus a "cause of action" instead of a writ) that some governmentalor corporate official was not validly elected to that office or is wrongfully exercising powers beyond (or ultra vires) those authorized by statute or by the

Q. 4. Explain Article 16 of the Constitution of India. [10 marks]

Answer:Due to the adverse effect of the aforesaid order dated August 29, 1997, various organisations including the Members of Parliament represented to the central Government for protecting the interest of the Scheduled castes and the Scheduled Tribes. The Government, after considering various representations, reviewed the position and has decided to make amendment in the constitution so that the unfilled vacancies of a year, which are reserved for being filled up in that year in accordance with any provision for reservation made under clause (4) or clause (4A) of article 16 of the Constitution, shall be considered as a separate

Q. 5. What are the parliamentary privileges bestowed to the Press? [10 marks]

Answer: Whether it is in the public interest that the law should so remain is open to considerable doubt. In the light of s13 of the Defamation Act 1996, we submit that the need for change has now become overwhelming. The proper monitoring of Members' behaviour must be of manifest importance to the public at large. It is part of a newspaper's duty to monitor that behaviour.

S13 of the 1996 Defamation Act has already limited the effect of Article 9 of the Bill of Rights. It allows MPs to waive their privileges in order to

Q. 6. What are the laws governing the Press in reporting court proceedings? [10 marks]

Answer:A court is the place where society employs specially trained people to decide whether or not a person really did something wrong.

If a crime has been committed, then the police need to find the person responsible; but it is not the job of the police to punish that person. That is the job of the courts, and before they punish anyone they need to be convinced that the police have
